How Long Does a Warning Stay Valid in South Africa?

LabourSoft 25 April 2026

One of the most common questions in South African HR is how long a disciplinary warning remains valid. The answer matters because progressive discipline — the cornerstone of fair dismissal procedure under the Labour Relations Act — depends on building on valid, current warnings. If a warning has expired when you issue the next step, you may be starting from scratch.

The Standard Validity Periods

The LRA and its accompanying Code of Good Practice: Dismissal do not prescribe specific warning validity periods — they require that discipline be progressive and fair. In practice, South African labour law, CCMA case law, and SABPP (South African Board for People Practices) guidelines have established widely accepted norms:

Standard warning validity periods:
Verbal Warning — 3 to 6 months
Written Warning — 6 months
Final Written Warning — 12 months

These periods are not absolute law — they are industry norms that have been repeatedly upheld by the CCMA and Labour Court as reasonable. Your company disciplinary code should specify your chosen periods. If it doesn't, the above defaults apply.

Why Warning Validity Matters

Progressive discipline means each step in the disciplinary process builds on the previous one. If an employee received a written warning six months ago for repeated lateness and is late again today, the valid written warning supports issuing a final written warning. If that written warning expired yesterday, the situation is different — you may need to start again with a verbal or written warning, depending on the severity of the current offence.

CCMA commissioners regularly scrutinise warning validity when reviewing dismissals for fairness. An employer who issues a final written warning based on an expired written warning risks a finding of procedurally unfair dismissal.

The Clock Starts on the Date of Issue

Validity is calculated from the date the warning was issued, not the date the offence occurred. If you issued a written warning on 1 March, and your policy specifies 6 months validity, the warning expires on 31 August — regardless of when the underlying incident took place.

Practical tip: Always date your warning documents correctly and keep them on the employee's file. LabourSoft tracks warning validity automatically — each warning shows a Valid or Expired status in real time, so you always know what is in play before issuing the next step.

Expired Warnings and Dismissal

An important nuance: an expired warning cannot be used as the basis for progressive discipline, but it is not entirely irrelevant. CCMA case law has held that expired warnings may be considered as part of the employee's overall disciplinary history when assessing the appropriateness of dismissal — particularly in cases where a pattern of similar behaviour is established. The warning cannot be the trigger, but it can support a finding that the employee was aware of the standard of conduct required.

Special Cases: Serious Misconduct

Not all misconduct is progressive. The Code of Good Practice: Dismissal recognises that certain offences — theft, fraud, assault, sexual harassment, gross insubordination — may justify dismissal on a first offence without prior warnings. In these cases, validity periods are irrelevant because the issue is the gravity of the act, not a pattern of behaviour.

Your Company Disciplinary Code

South African employers are strongly advised to have a written disciplinary code that specifies:

LabourSoft's Warning Progression feature enforces your company's disciplinary code automatically — when an HR admin selects an offence, the system checks the employee's valid warning history and specifies exactly what step comes next. There is no guessing and no risk of issuing a sanction that skips a required step.

Conclusion

Warning validity is not a technicality — it is a substantive procedural requirement that protects both the employer and the employee. Keeping track of which warnings are still in play, and for how long, is an essential part of fair IR management.
